Tempe Police are seeking misdemeanor charges against 21-year-old Eryn Bonner following a July 19 confrontation on Mill Avenue. The move comes after Maricopa County Attorney Rachel Mitchell declined to file felony charges in the case.

The incident, captured on viral video, shows the Arizona State University senior yelling at officers before they detained her. Her attorney, Ben Taylor, shared images of injuries Bonner says she suffered during the confrontation and stated, “she’s physically injured, she’s emotionally injured, and she’s just traumatized from this.” Police submitted misdemeanor charges to Tempe City Court, including assault, resisting arrest, disorderly conduct, and obstruction.

Tempe Police say the incident is currently under administrative review and that allegations will be reviewed fairly and impartially. Tempe Officers Association President Robert Ferraro stated that video shows Bonner ignoring multiple commands to back away and lashing out at an officer. Taylor maintained that citizens have First Amendment rights to record or speak to police officers.
